A lawyer for the man accused of murdering a man inside a New Scotland home in April is trying to get the charges against him dropped.

Jacob Klein's attorney filed a motion claiming the grand jury that indicted him earlier this year may have been influenced by comments the Albany County Sheriff made to the media. Klein is accused of stabbing Philip Rabadi to death. He has pleaded not guilty to a second degree murder charge.
