The New York Court of Appeals has ruled that lap dancing is not an art form and is subject to sales tex, despite assertions by Night Moves owner Stephen Dick Jr. and his attorney that lap dancing is covered by the state’s exemption from sales tax for “dramatic or musical arts performances.”
